Terms and Conditions for Artist in Residence Program

Here below are the Terms and Conditions of our Artist in Residence Program. Please ensure you have read these Ts and Cs prior to submitting your application. 

  1. GENERAL TERMS

    • These Terms and Conditions govern the submission of artworks to High Tees ABN 28 132 771 284 we/us/our for the Artist in Residence Program (the Program).

    • By making a Submission to the Program, you agree to be bound by these Terms and Conditions. Please review these Terms and Conditions carefully before making any Submission to the Program.

  2. DEFINITIONS
    • “Portal” is the application form.
    • “Program” is High Tees’ Artist In Residence Program.
    • “Program Brief” is a separate document setting out specific requirements for each particular program.
    • “Submission” is your Works submitted to the Program and any of your personal details included as part of the submission as required by the Program Brief.
    • “Works” is your original artwork
  3. PARTICIPANT ELIGIBILITY AND REGISTRATION
    • The Program is open to any Participant aged 18 and over.
    • Each participant must be a citizen or permanent resident of Australia or New Zealand.
    • By making a Submission to the Program you confirm that you fully comply with the eligibility requirements.
    • We reserve the right to verify your eligibility and to adjudicate any dispute regarding eligibility at its sole discretion. You agree to provide the us with any proof of eligibility requested, and refusal or failure to provide such proof within 5 (five) days of our request will result in disqualification from a Program.
    • To submit an entry to the Program you must do so through our Portal. We will not accept any Submission made through any other means. You must provide true and accurate information about yourself and your Works in your Submission.
    • By submitting an entry to the Program, you agree to the processing of any personal data and information according to our Privacy Policy.
  4. SUBMISSIONS
    • You must only submit Works that are wholly your original artworks.
    • You confirm and warrant that the Works does not infringe any copyright or other intellectual property rights of any third party.
    • You shall be ready to supply copyright licenses for images used in any Works if requested by us. A failure to supply such licenses within the period specified by us may be grounds for disqualification from the Program.
    • Your Submission must strictly and completely conform to the Terms and Conditions and the rules and guidelines set out in the Program.
    • You must watermark your Works submitted through the Portal to ensure that it is clear to us that you are the artist of the Works.
    • You must upload your Works prior to the deadline for the Program, which is 02/06/22.
    • You acknowledge and accept that we will make best endeavours to ensure that all works submitted to us for the Program are original works. However, if a successful entrant has infringed on your intellectual property works then you will only have a claim against that entrant directly and you fully release us and hold us harmless for any infringement of your intellectual property that may have occurred as a result of the Program.
    • By making a Submission, you acknowledge and agree that all aspects of any Submission may be used by us for marketing and publicity purposes.
  5. DISQUALIFICATION OF SUBMISSIONS
    • You will be disqualified if non-compliance with these terms and conditions, including in case of providing false information about yourself in your Submission.
    • Any Submissions that do not comply with these terms and conditions, the Program Brief or other applicable requirements will be disqualified.
    • All Submissions received by us after the closing date and time for Submission will be automatically disqualified.
    • We will notify you regarding the disqualification of a Submission. Our decision regarding your disqualification is final, at our absolute discretion and no appeals will be allowed. We are not obliged to explain to you our decision regarding your disqualification.
  6. CANCELLATION OF THE PROGRAM
    • We reserve the right to cancel or suspend the Program or alter the terms and conditions and/or the Program Brief and/or other applicable requirements at any time and stage at our own discretion, including but limited if it is considered necessary or if circumstances arise outside of our control.
  7. SELECTION OF THE SUCCESSFUL ENTRANTS
    • You acknowledge that we have the sole discretion to decide on the successful entrants of the Program. We have no obligation to accept your Submission for the Program.
    • Our decision on the choice of successful applicants for the Program is final and no appeals will be allowed.
    • We are not obliged to explain to you our decision on the choice of the successful applicants for the Program.
    • If your Submission is successful, then you are required to enter into a copyright licence with us before commencing the Program to ensure that you and us are able to run the Program successfully and to ensure that you receive a royalty payment for any sales of products by us that use your Works, as described in the Program Brief. The copyright licence requires that we have exclusive rights over the Works for 6 months and non-exclusive rights to use the Works for perpetuity. We have the right to disqualify your Submission if you refuse to enter into a copyright licence with us.
    • If your Submission is successful you agree to participate in the promotional activities and the publicity arrangements for the Program. We are authorised to use any and all statements made by you in connection with the Program without additional approval and consent.
  8. LIABILITY AND INDEMNITY
    • By registering or providing a Submission for the Project, you agree to release, discharge and hold harmless us from any claims, losses, damages, expenses and liabilities (including legal costs on a solicitor client basis) arising out of your involvement in the Program, the provision of any Submission, any exploitation of Submission by us, including any infringement of Intellectual Property Rights, or any other of your activities related to the Program.
  9. GENERAL TERMS
    • These terms and conditions are subject to the laws and the exclusive jurisdiction of the Courts of Victoria, Australia
    • If any term (or part of a term) of these terms and conditions is invalid, illegal, or unenforceable, the rest of the terms and conditions will remain in effect.
    • We have the right to unilaterally revise, amend or change these terms and conditions without notice.
    • When making changes in the current wording of these terms and conditions, the date of the last amendment is indicated.
    • The new wording of the terms and conditions shall enter into force from the moment of its posting on the Portal.
